Tutoring Contract 

  

FOR TEST PREPARATION ONLY  

The parties to this Agreement are the Student, the Parent(s) and/or Legal Guardian(s) of the Student (“Client”), and Florida Online Academic Test Prep (“Tutor”). The intent of the Agreement is to establish the terms, as set forth below, of the Client/Tutor relationship.   

This contract is between Florida Online Academic Test Prep, hereinafter referred to as the “Tutor” or as Florida Online Academic Test Prep, if necessary. The Student and/or the Parent(s) or Legal Guardian(s) of the Student, hereinafter referred to as the “Client”  

The Client and the Tutor are entering into an Agreement whereby the Tutor will provide test preparation services to the Client. The test preparation services shall commence on the agreed upon date as set forth by Florida Online Academic Test Prep and shall continue until the test preparation sessions end. All test preparation sessions will be completed online. To maximize learning, a quiet area with limited distractions, is strongly recommended.  

All group test preparation sessions have been predetermined and the Client agrees that to be present for the proposed days and times that Florida Online Academic Test Prep has set. Private test preparation sessions are to be determined by the availability of the Tutor and the Client. Either party reserves the right to change the day and time of the test preparation session if the other party is in agreement. All changes must be communicated in writing.  

By acknowledging electronically, the Client agrees to the above mentioned terms and all of the attached policies and procedures. Any changes to these terms must be communicated and agreed to in writing at a later date.  

  

POLICIES AND PROCEDURES  

Florida Online Academic Test Prep requires the tutoring contract to be acknowledged electronically before test preparation services can begin.   

  

FEES PAYABLE TO THE TUTOR  

Fees for test preparation services shall be paid via debit, credit, or PayPal. Florida Online Academic Test Prep does not accept cash, check, or any other forms of payment. Questions or concerns regarding payment may be sent to billing@floatprep.com  

  

PAYMENT  

Payment is required prior to the start of test preparation services. All payments must be made online. The Client may also choose a partial payment plan, if available, but the Client is responsible for adhering to the payment schedule as outlined. Florida Online Academic Test Prep does not offer any refunds for any reason. If the Client chooses to cancel test preparation services, then the Client forfeits all monies paid to Florida Online Academic Test Prep. If the Client is dissatisfied with the scores received on the official SAT or ACT test, then the Client may retake the test preparation sessions as outlined below.    

Florida Online Academic Test Prep does not offer refunds at this time. Once a student has enrolled, the expectation is that the student will complete all sessions. If for whatever reason the student has paid, but is unable to attend the session, then that student may take that session at a later date. If the student decides not to complete the sessions, then the student forfeits all payments made to Florida Online Academic Test Prep. 

  

CANCELLATION OF LESSONS BY STUDENT  

Only for Private Test Preparation Sessions: In the event that the Client is unable to attend an upcoming session, the Client promises to contact Florida Online Academic Test Prep at least twenty-four (24) hours before the scheduled test preparation session. All reasonable circumstances will be handled on a case-by-case basis. If the Client is not present on the agreed upon date and time or if the Client is more than fifteen (15) minutes late, without any prior notification, the Client is considered a No-Show. If the Client is a No-Show, the Client is still responsible for payment of the test preparation session and forfeits the right to a make-up session or any other remedy. Repetitive late cancellations and/or No Shows will result in termination of test preparation services.  

The Client must present payment for the test preparation session in which the Client was a No-Show prior to the next test preparation session for test preparation services to continue. Until full payment is made, all future test preparation sessions will be suspended.  

If a Client provides sufficient twenty-four (24) hour notice, no charges will be applied to the Client’s account. Florida Online Academic Test Prep is unable to accommodate more than two (2) make up sessions per month for missed sessions. The Client is only allowed two (2) cancellations per month without a charge of penalty even if sufficient notice has been given. This is to protect the integrity of the test preparation sessions for the Client.   

Only for Group Test Preparation Sessions: In the event that the Client is unable to attend an upcoming session, the Client is not eligible for a refund or a make-up session since all test preparation sessions are pre-determined. The Client forfeits the right to a retake if the Client receives an unsatisfactory score on the official SAT or ACT exam.  

  

CANCELLATION OF LESSONS BY TUTOR  

In the event that the Tutor is unable to attend an upcoming session, the Tutor promises to contact the Client as soon as possible, but not later than twenty-four (24) hours before the scheduled tutoring session except in emergency situations. The Tutor shall reschedule the appointment at a time agreeable to both the Tutor and the Client.   

  

LATE POLICY  

Only for Private Test Preparation Sessions: In the event that the Client arrives late for a test preparation session, the Client is still responsible for paying the full amount for the agreed upon time period, even if as a consequence a test preparation session must be cut short due to the Client’s tardiness. However, at the Tutor’s sole discretion and provided there is no scheduling conflict, test preparation sessions may continue past the original end-time in order to accommodate the Client whenever possible, up to the original session length. If the Tutor is late for a test preparation session, the Tutor will stay after the designated end time up to the original session length to accommodate for the time missed.   

Only for Group Test Preparation Sessions: If the Client is not present on the agreed upon date and time the Client is considered late. If the Client is more than fifteen (15) minutes late, the Client is considered No Show even though the Client is present during instruction. If the Client is consistently late or is No Show, the Client is still responsible for payment of the test preparation session, forfeits the right to retake the test preparation sessions if the Client receives an unsatisfactory score on the official SAT or ACT exam, or any other remedy. Repetitive late cancellations and/or No Shows will result in termination of test preparation services. If the Tutor is late for a test preparation session, the Tutor will stay after the designated end time up to the original session length to accommodate for the time missed.   

  

OBLIGATIONS OF THE TUTOR  

  • Arrive on time and attend all scheduled test preparation sessions.  
  • Be prepared prior to test preparation sessions and structure test preparation sessions in such a way as to optimize time to the benefit of the Client.  
  • Keep all information of the Client confidential.  
  • Contact other parties involved in the education of the Client only if given written permission by the Client to do so.  
  • At no time be required or obliged to execute assignments on behalf of the Client.  

  

OBLIGATIONS OF THE STUDENT  

  • Assist the Tutor in identifying problem areas in which the Client needs specific support.  
  • Arrive on time and attend all scheduled test preparation sessions.  
  • Bring all necessary materials (i.e., workbooks, assignments, etc.) to each test preparation session.  
  • Prepare for sessions by determining what needs to be covered and sharing that information with the Tutor.  
  • Participate actively in all aspects of the test preparation sessions by asking questions, completing assignments, participating in discussions, etc.  

  

WARRANTIES AND THE FLOAT PREP GUARANTEE 

The success of the Client is dependent upon many factors including, but not limited to: the amount of studying achieved per week, the motivation of the Client, the involvement of the Parent(s) and/or Legal Guardian(s), the preparedness of the Client at each test preparation session, etc. Therefore, the Tutor makes no promises or warranties with regards to a Client’s performance as a result of any test preparation provided.  

However, if the Client scores below the expected course average increase on the official SAT or ACT exam, or if the Client receives a score lower than a previous score on the official SAT or ACT exam, the Client may be eligible to retake the same test preparation sessions, as previously provided, for free. 

To be eligible the Client must meet the following criteria: 

  • All test preparation services have been paid in full, meaning no monies are owed to Florida Online Academic Test Prep. 
  • The Client received a score below the expected course average increase or received a score lower than an official SAT or ACT exam the Client took previously. That official SAT or ACT exam must have been taken within 90 days to qualify. 
  • The official SAT or ACT exam in which the Client is dissatisfied must have been completed within 90 days of completing a test preparation session with Florida Online Academic Test Prep. 
  • The Client must have fully attended all test preparation sessions and completed all homework and assignments. If the Client was more than fifteen (15) minutes late, late repeatedly, or a No Show the Client is ineligible. 
  • The Client must not have used the guarantee already for the same purchase. The guarantee can only be used for one paid purchase at a time. 

The Client is able to retake the test preparation session as soon as the next test preparation session is available. The Client will have six (6) months after receiving the official SAT or ACT test scores to invoke this guarantee. The test preparation session must be in the same format and for the same official test as previously enrolled. For example, the Client must re-enroll in the SAT test preparation sessions if the Client previously completed the SAT test preparation session. The Client cannot suddenly decide to enroll in ACT test preparation sessions. The same is true for private sessions and group sessions. The Client must re-enroll in group test preparation sessions if the Client already completed group test preparation sessions. 

Florida Online Academic Test Prep does not offer refunds of any kind. And the Client only has access to this guarantee once pre-paid purchase. Once the Client chooses to retake the test preparation sessions, the Client is no longer eligible for the Florida Online Academic Test Prep Guarantee. 

  

EXPECTED AVERAGE COURSE INCREASE  

SAT 48 Sessions- 150 point increase 

SAT 32 Sessions- 100-120 point increase 

SAT 24 Sessions- 70-90 point increase 

ACT 48 Sessions- 5-6 point increase 

ACT 32 Sessions- 4-5 point increase 

ACT 24 Sessions- 3-4 point increase 

  

FOR ENGLISH AND MATH TUTORING ONLY

Tutoring sessions are to be determined by the availability of the Tutor and the Client. Either party reserves the right to change the day and time of the tutoring session if the other party is in agreement. All changes must be communicated in writing.

CONFIDENTIALITY  

Florida Online Academic Test Prep may have access to the confidential records of the Client. These documents may be provided by the Client’s school, doctor, or other organization. These include documents like the Individualized Education Plans, grades, medical records, etc. The Tutor will only have access to these documents if given express written permission by the Client. If Florida Online Academic Test Prep is given express written permission for access to these documents, Florida Online Academic Test Prep will hereby keep all information within these documents confidential. In turn the Client must give express written permission for the Tutor to correspond with the Client’s school, doctor, or other organization, so as not to breach the confidentiality of the Client’s privacy.
